Terms of Service

You must be at least 16 years of age to use Klugon. By accepting these Terms you represent that you have the legal capacity to enter into a binding agreement. If you are using Klugon on behalf of a business, you represent that you have authority to bind that business.

Klugon provides an AI-powered customer communication platform including chatbot builders, knowledge base tools, booking engines, voice assistant integration, and related features ("Service"). We may modify, suspend, or discontinue any part of the Service with reasonable notice.

You must provide accurate and complete information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@softaar.com if you suspect unauthorized access.

Klugon is offered on a subscription basis. Prices are displayed on our pricing page and are exclusive of applicable taxes. Subscriptions renew automatically at the end of each billing period unless cancelled.

We use Stripe for payment processing. By providing payment information you authorise Stripe to charge your payment method on our behalf. We do not store full credit card numbers.

Paid subscriptions begin after a 7-day free trial period. You will not be charged during the trial. You can cancel at any time before the trial ends to avoid any charge.

Refunds are provided at our discretion. To request a refund, contact contact@softaar.com within 14 days of charge.

You agree not to use the Service to:

• Send spam, unsolicited messages, or engage in phishing or fraud
• Violate any applicable law or regulation, including data protection laws
• Infringe on the intellectual property rights of others
• Attempt to reverse-engineer, scrape, or disrupt the Service infrastructure
• Process sensitive personal data (health records, financial data, children's data) without ensuring adequate safeguards and disclosures to your end users
• Deploy AI assistants in a manner that deceives end users into believing they are speaking with a human, where such deception is harmful

We reserve the right to suspend or terminate accounts that violate this section.

You retain ownership of all content, knowledge base materials, and customer data you upload to Klugon ("Your Content"). By uploading content, you grant us a limited, non-exclusive licence to process it solely for the purpose of providing the Service.

You are responsible for ensuring you have the rights to upload Your Content and that its processing complies with applicable data protection laws, including obtaining any necessary consents from your end users.

We do not sell Your Content to third parties or use it to train AI models without your explicit consent.

The Service uses large language models (including OpenAI) to generate responses. AI-generated content may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and validating AI output before relying on it for business-critical decisions. We do not warrant that AI responses are accurate or error-free.

Klugon may connect to third-party services (Twilio, HubSpot, WhatsApp, etc.) through integrations you configure. Use of those services is subject to their own terms and privacy policies. We are not responsible for the acts or omissions of third-party services.

The Klugon name, logo, platform software, and documentation are the intellectual property of Softaar Technologies UG and are protected by applicable IP laws. Nothing in these Terms transfers ownership of our intellectual property to you.

To the maximum extent permitted by applicable law, our aggregate liability for any claims arising from or related to the Service is limited to the fees you paid to us in the 3 months preceding the claim.

We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.

These limitations apply to the fullest extent permitted by German law.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.

You may terminate your account at any time from your account settings. We may suspend or terminate your account if you breach these Terms, with or without prior notice depending on the severity of the breach.

On termination, your right to use the Service ceases immediately. We will retain Your Content for 30 days following termination, after which it will be deleted unless retention is required by law.

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions and the United Nations Convention on Contracts for the International Sale of Goods.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Dresden, Germany, provided that mandatory consumer protection provisions of your country of residence remain unaffected.

We may revise these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
